1. Who We Are

Fluctus is a Barbadian company being registered by its co-founders, Adam Worrell and Teddy Allen. Until it is incorporated, the co-founders run this site and stand behind these terms; on incorporation the company takes them over. Contact admin@fluctus.cloud.

2. Using the Site

You may read the site, share links to it and use the free glance for your own purposes. You may not interfere with the site, probe or overload it, scrape it in bulk, or use it to break the law. We may block traffic that does any of those things.

3. The Glance and Its Licence

The glance is the latest wave height, period and direction at each buoy, refreshed hourly, which anyone can see without an account. The glance is free to view and quote with attribution. Bulk reuse, republishing it as a feed, or resale is not permitted. Attribution means naming Fluctus and, online, linking to fluctus.cloud. Detailed readings, history, forecasts and alerts are paid products, or free under our Free Access Commitments.

4. Sample Data

Until the first buoy is moored and reporting, every reading, chart and app screen on this site is a sample that shows what the service will look like. Samples are marked as such and must not be relied on as measurements of the sea.

5. Safety

Readings and alerts are advisory. They do not replace official warnings from the Barbados Meteorological Services or the Coast Guard, and you remain responsible for your own decisions at sea. Buoys can stop reporting because of storms, vessels or faults, and a missing reading is not a sign that conditions are safe.

6. Backing, Partnerships and Paid Products

Backing a phase of the campaign is governed by the Founding Backer Terms. Partnerships are governed by a separate sponsorship agreement. The Surfer subscription and the data API will have their own terms, published before they go on sale, and nothing in them can restrict the Free Access Commitments.

7. Our Content

The text, drawings, figures and the proposal PDF on this site belong to Fluctus and its co-founders. You may quote short passages and reproduce single figures with attribution for news, review, teaching or research. Copying the site or the proposal wholesale, or presenting our work as your own, is not allowed. Product and organisation names belong to their owners and are used only to describe facts.

8. Links to Other Sites

We link to sources and partners we think are useful. We do not control those sites and are not responsible for what they publish or how they handle your data.

9. No Warranty

The site and the free glance are provided as they are. We work to keep them accurate and available, but we do not promise that they are error-free or always online, and we may change or withdraw features, subject only to the Free Access Commitments and the Founding Backer Terms.

10. Our Liability

To the extent the law allows, we are not liable for any loss that comes from relying on the site, the free glance or a sample, or from the site being unavailable. Nothing in these terms limits liability that the law does not allow us to limit, including for death or personal injury caused by our negligence, or for fraud. Where we have a paid contract with you, that contract sets our liability under it.

11. Privacy

How we handle personal data is set out in our Privacy Policy, which forms part of these terms.

12. Changes

We may update these terms. The date at the top shows the current version, and a change that reduces your rights applies only from the date it is published, never to a backing you have already paid for.

13. Governing Law

These terms are governed by the laws of Barbados, and the courts of Barbados have jurisdiction over any dispute about them.
